In April 2017, the European Commission denounced Spain before the Court of Justice of the European Union for possible non-compliance with the regulation on rules of access to the profession of transporter, considering that the minimum requirement established in Spanish legislation could be disproportionate and discriminatory.
The Court of Justice of the European Union has ruled by a judgment handed down on February 8, not to accept the arguments of the Spanish Government and confirms that any company that has at least one vehicle must be able to obtain a public transport authorization.
The Spanish government based its defense on establishing the minimum fleet requirement to offer more transparency and greater legal and economic security to commercial relations between carriers and their customers.
Following the publication of the ruling by the European Court, the Spanish Government is obliged to take the necessary measures to put an end to the breach of European regulations.
